Professional Journey:

Joel joined MBA Incorporated in January 2025 as a Senior Associate. Prior to joining MBA Incorporated, Joel served as a Judge’s Secretary in the Gauteng High Court. He completed his articles at a boutique law firm in Rosebank and practised as an attorney at two international law firms - Dentons and Fasken.

Experience Highlights:

  • Homeowners Association: Assisting with the successful review of a decision of the MEC for DEDEAT in the Eastern Cape, involving an appeal brought under section 43 of the National Environmental Management Act of 1998 (NEMA). The appeal involved the proper interpretation of section 3(3)(a) of the National Forests Act. This was upheld by the Supreme Court of Appeal. It also involved the interpretation of section 17(3) of NEMA and at what stage of an environmental dispute an aggrieved citizen can compel the state to commence a statutory conciliation or mediation process.
  • SOC: Acting on behalf of a state-owned enterprise opposing various claims brought by a sub-contractor in terms of FIDIC. This involved various proceedings before DAB panels.
  • Global Chemicals Company: Assisted with proceedings before the Competition Tribunal over the course of two years in a request for consideration of an intermediate merger (which included substantial dealing with the Competition Commission and intervening parties in the gold mining industry). This entailed assisting with the preparation of correspondence, documents and numerous bundles on behalf of the merging parties; liaising with counsel and experts; and attending meetings and Tribunal hearings.
  • Cryptocurrency trading platform: Assisting with advice on jurisdiction, security for costs, and instituting action for the recovery of money under unjustified enrichment.
  • UK Government Department: Preparing an extensive memorandum dealing with procurement principles in South Africa, expedited procurement, and off-balance sheet financing. This entailed considerable research on the PFMA, the MFMA, the PPPFA, and the IDA (Infrastructure Development Act).
